Media should not run parallel case
पिछले कुछ दिनों से लोग अभिनेता सुशांत सिंह राजपूत सुसाइड केस पर अदालतो से अलग
एक समानांतर मुकदमा देखते रहे: कइयों ने इसे देखकर न केवल आश्चर्य प्रकट किया
बल्कि इसे मीडिया का अनावश्यक दखल भी कहा: वास्तव में यह क्या था और क्यों किया
गया यह सोचने का विषय है टीवी स्क्रीन पर कुछ चैनलों द्वारा एक किसी आपराधिक
मामले की रनिंग कामेन्ट्री अपने आप में सोचने का विषय था: कुछ अच्छी बाते भी हुई
जिसमें कुछ विद्वानों और कानून के जानकारों ने ऐसा करने वालो पर न केवल तंज कसा
बल्कि फटकार भी लगाई:एक बहुत बडे एडवोकेट ने तो इसपर कह ही दिया कि में तो ऐसा
पहली बार देख रहा हूं जहां आरोप लगने वालों को पहले ही दोषी करार दे दिया गया यहां
तक कि सजा भी मुकर्रर कर दी गई जबकि एक अन्य एडवोकेट ने पूछा देश में और कितनी एजेंसियां है जिससे इस
मामले की
जांच कराने की जरूरत है क्या सेना की जरूरत पडेगी?:यह दिलचस्प
किस्से स्वतंत्र भारत में जहां प्रेस और मीडिया को काम करने की पूरी छूट है मिला
लेकिन ऐसा भी पहली बार लगा कि इस छूट का दुरूपयोग पहली बार ही किया भी गया: कतिपय
मीडिया संस्थान तो इस केस का समानांतर मुकदमा चला रहे थे तथा किसी को भी अपने ढंग
से न केवल अपराधी घोषित करते रहे बल्कि उसे अपने अपने ढंग की सजा का ऐलान भी करते
रहे:यह अच्छा हुआ कि अंतत: भारतीय प्रेस परिषद ने इस मामले में संज्ञान लिया तथा
सुशांत सिंह राजपूत केस में कतिपय मीडिया संस्थानों की भूमिका पर सवाल उठाये तथा सुशांत
सिंह राजपूत सुसाइड केस की रिपोर्टिगं पर कड़ी आपत्ति जताई: प्रेस परिषद ने 28
जुलाई को कहा कि मीडिया को ऐसे मामलों
में कवरेज में पत्रकारिता आचरण के नियमों का पालन करना चाहिए. परिषद ने मीडिया
संस्थानों को इस मामले में अपना स्वयं का ‘समानांतर
मुकदमा’ नहीं चलाने की नसीहत भी दी.पीसीआई ने एक परामर्श में
मीडिया को इस तरह से खबरों को नहीं दिखाने कहा जिससे आम जनता आरोपित व्यक्ति के
मामले में संलिप्तता पर विश्वास करने लग जाए. परिषद ने कहा कि उसने अफसोस के साथ
इस बात को संज्ञान में लिया है कि किसी फिल्म एक्टर की कथित खुदकुशी के मामले की
कवरेज कई मीडिया संस्थानों द्वारा पत्रकारिता आचरण के नियमों का उल्लंघन है और
इसलिए मीडिया संस्थानों को पीसीआई द्वारा तय नियमों का पालन करने की सलाह दी जाती
है.पीसीआई ने मीडिया को यह भी सलाह दी है कि पीड़ित, गवाहों, संदिग्धों और आरोपियों को अत्यधिक प्रचार देने से बचा
जाए क्योंकि ऐसा करना उनकी निजता के अधिकार में अतिक्रमण होगा. पीसीआई ने यह भी कहा कि अपराध के बारे में आधिकारिक एजेंसी द्वारा
की जा रही जांच की दिशा के बारे में सुनी सुनाई बातों के आधार पर सूचनाओं को सार्वजनिक
करना वांछित नहीं है. उसने यह भी सलाह दी कि अपराध से जुड़े मामले में दैनदिन आधार
पर बहुत बल देते हुए खबरें देना तथा साक्ष्यों की सच्चाई निर्धारित किए बिना उन पर
खबर देना उचित नहीं है.परामर्श में कहा गया है कि इस प्रकार की रिपोर्टिेंग से निष्पक्ष
जांच एवं मुकदमे पर अकारण दबाव पड़ता है. परिषद ने मीडिया द्वारा गवाहों की पहचान
उजागर करने से भी बचने की ताकीद दी है
क्योंकि इससे उन पर आरोपी और जांच एजेंसियों के दबाव में आने का खतरा होता है. परिषद
ने देर से ही सही इस मामले में संज्ञान लिया जिससे कम से कम यह तो फायदा हुआ है कि
ऐसे किसी मामले में कोई निर्दोष जेल की सलाखों के
पीछे नहीं पहुंच सकेगा: देश की पत्रकारिता का एक गौरवपूर्ण्ा स्थान है
तथा संविधान ने भी पत्रकारों को अपनी
भूमिका निष्पक्ष व स्वतंत्र तौर
पर अपनी सीमा में रहकर निभाने का पूरा मौका दिया है इसका पालनकर अपने दायित्व को
सारे तथ्यों की जांच परख और पूर्ण जिम्मेदारी से निभाने की जरूरत है:

The council also advised media institutions not to conduct their own 'parallel litigation' in the case. The PCI, in a consultation, asked the media not to show the news in such a way that the general public would believe the accused person's involvement in the case. Go The council said that it has regrettably taken cognizance that coverage of a film actor's alleged suicide case is a violation of the rules of journalistic conduct by many media institutions and hence media institutions have to follow the rules set by the PCI The PCI has also advised the media to avoid giving excessive publicity to the victims, witnesses, suspects and accused as doing so would be an encroachment on their right to privacy. The PCI also said that it is not desirable to make the information public on the basis of the things heard about the direction of investigation being done by the official agency about the crime. He also advised that it is not appropriate to give news on a day-to-day basis in a case related to crime and without giving any truth to the evidence.It has been said in the consultation that such reporting causes undue pressure on impartial investigation and prosecution. The council has also asked the media to refrain from revealing the identity of the witnesses as it puts them under pressure from the accused and investigative agencies. The Council has taken cognizance of this matter lately, which has at least benefited from the fact that in such a case no innocent will be able to get behind the bars of the country: the country has a glorious place of journalism and the Constitution has also given journalists It has given full opportunity to play its role in its limits in a free and independent manner, by following this, it is necessary to examine its responsibilities with all the facts and investigate it with full responsibility:
